Some cases settlement immediately after a lawsuit is filed. Most insurance companies have a different adjuster assigned to the claim once the suit is filed. This adjuster generally has more “settlement authority” than the initial claims handler.

Under Oklahoma Law, the defendant has 20 days to file an Answer after being served the lawsuit. The insurance company lawyers will file an Answer, then “issue discovery” to the Plaintiff.

Discovery Phase:

Both parties in the lawsuit will exchange information during the discovery phase. This can include answering written questions (“interrogatories”), producing documents (“requests for production”), and requests for admissions. Depositions start shortly after the discovery responses have been made.

Mediation and Negotiation:

Before going to trial, there’s often a mediation process where both sides try to reach an agreement. Most judges in Oklahoma City require a mediation.

A mediator is a “neutral third party” that facilitates communication between the parties to try to find a dollar amount that is agreeable to both sides. The mediator is paid by each side of the case, whether it is settled or not.

Each party will be at the mediator’s office but in separate rooms, with the mediator going back and forth. However, more and more local mediators are conducting mediation via Zoom. The setup is the same, but each party is in a separate “breakout room.”

Most cases (75+%) that go to mediation settle. Cases that don’t settle are generally caused by one of two reasons:

  1. The parties did not have all of the facts, so the valuations from both sides were too far apart. So, it was too early to mediate. If this happens, the case has a strong chance of settling at a second mediation after additional depositions have occurred.
  2. One or both sides have missevaluated what the case is worth. This type of case is headed to a trial.

Trial:

The case will go to trial if a settlement cannot be reached. Your lawyer will present your case in court, arguing in front of a judge or jury. The goal is to secure a judgment in your favor, granting you the financial compensation you deserve.

T. David Hasbrook

David is a founding partner of Hasbrook & Hasbrook, with extensive experience in personal injury law and jury trials. He obtained his undergraduate degree in Psychology from the University of Oklahoma in 1975 and his law degree from the same institution in 1978. After graduating, David served over four years on active duty with the United States Army as a lawyer in the Judge Advocate General’s Corps, gaining valuable trial experience. He continued his military career in the United States Army Reserves until 2006, retiring at the rank of Colonel.

David is admitted to practice before all state courts in Oklahoma, the United States District Courts for the Northern, Eastern, and Western Districts of Oklahoma, the Tenth Circuit Court of Appeals, and the United States Supreme Court.
